AFSPA ACT ( Armed Force Special Power Act ):

                         AFSPA ACT 1958                          

CONTEXT:-
After 32 Years , the controversial Armed Force (Speci power ) Act was partially removed from three of Nine Districts of Arunachal Pradesh but Would remain in Force in the Area boundering Mayanmar.

ABOUT AFSPA:
# ( AFSPA ) are Act of parliament of India that grant Special Power To Indian Armed Forces in Disturbed areas.

# The AFSPA given power to the Army and Central Forces replayed in "Disturbed Areas" to kill anyone acting in Contravention of low , Arrest and Search any premises Without a Warrant.

# It provides Cover to Forces From prosecution and legal suit's Without the Centre's Sanction.


DISTURBED AREA:-
# A Disturbed Area is one which declared by notification Under Section 3 of AFSPA .

# An area can be Disturbed due to differences of Dispute between members of different religions, Racial , Language or Regional groups or Caste's or Communities.

# The Central Government , or the Government of the State or Administrator of the Union Territory can Declare the Whole or Part of the state Or union territory as a Disturbed Area.

# A Suitable Notification Wouy have to be made in the official Gazette. As per Section 3 It can be Invoked in places Where " The Use of Armed Forces in Aid of the Civil power is necessary.

BACKGROUND OF AFSPA:-
# The Act come into Force in the context of Increasing Violation in the Northeast state decades Ago , Which the state's Government Found Difficulties control.

# The AFSPA BILL was passed by both the House's of Parliament and it was approved by the President on September 11, 1958.

# It became known as the Armed Forces Special Power Act , 1958.

SUPREME COURT RULING:-
# On 8 July 2016 , In a Land Mark ruling Supreme Court Said that any Encounter Carried out by Armed Forces in the Garb of AFSPA should be subjected to Through Inquiry.

# In the Same Judgement Supreme Court of India endey the Immunity of the Armed Forces From prosecution Under AFSPA .
